“Swiss StartCup Challenge 2022” is a call for projects linked to circularity and hosted on the website (hereinafter the “Website”) from 17.05.2022 until 07.07.2022 (details of the deadline for submission below). The Swiss StartCup Challenge 2022 is a contest open to three categories of participants: START-UPS, SMEs and STUDENTS based in Switzerland.


• SMEs: All companies registered in Switzerland, running for more than 2 years and with fewer than 250 full time employees.
• STARTUPS: All companies registered in Switzerland, running for less than 2 years.
• STUDENTS: University students currently studying in Switzerland with a valid 2022 student ID number.


1. Scope & application

1.1      Nestlé Nespresso SA, Chaussée de la Guinguette 10, 1800 Vevey, Switzerland ("Nespresso") and B-Lab Switzerland (Rue de Lyon 77 1203 Geneva) are the organizers of this contest ("the Contest"), which is open to START-UPS, SMEs and STUDENTS in Switzerland (“Participant[s]”).
1.2      By submitting an entry or participating in the Contest, the PARTICIPANT confirms his/her understanding and acceptance of these Rules.
1.3      The Contest is free to enter, and no purchase of any kind is necessary.
1.4      Nespresso reserves the right to check the application details and to reject an entry not fitting the challenge purpose or not in line with Nespresso’s and B-Lab’s values and objectives.
1.5      Participants shall have a general legal obligation and duty of honesty, fair play, and loyalty in relation to all aspects of the Contest.
1.6      These Rules shall be read and applied in a manner consistent with the purpose and intent of the Contest.
1.7      Any breach of the Rules will invalidate an entry. If a breach has occurred but is discovered after the awarding of a prize, Nespresso may request equivalent compensation at its discretion.


2. Purpose & Outline

2.1      The overall purpose of this Contest is to select the Participant with the best innovative ideas and best practice to foster the circular economy. If circularity is not the Participant’s core business, the winner may also be selected on how the Participant is addressing this challenge and/or how the Participant is bringing circularity in his/her product lifecycle.
 2.2      To this end, each Participant who wants to participate will have to submit an application reflecting the theme “Addressing circularity with your project”. The application will be entirely available online ( and is composed of:
• An application form with questions regarding the applicant, his/her business model, and his/her circular initiative
• A written description with a business model answering questions, “Business Model details” (information used for internal selection only - not public)
• A summary of the project, “Business Summary”
• A 60-90 second maximum video describing your business model. 9:16 vertical format


3.  Timetable

The following summarizes the timetable for the Contest, subject to the detailed Rules herein:
• The Contest begins at 12:00am (CET) on May 17th, 2022 and ends at 12:00 (CET) on July 7th, 2022 (the “Entry Period”). Entries submitted after the Entry Period will not be eligible.
• Following a first screening, all accepted entries will appear on the dedicated website up to a total of 100 Participants in all categories.
• A first assessment of all accepted entries will be done by a panel of experts (Nespresso sustainability experts) from July 8th to August 26th, 2022 (The “Assessment Period”). 24 applications, 8 per category, will be selected during this phase.
• On August 26th, the jury composed of experts from Nespresso and B-Lab, business leaders, and media specialists will select three finalists in each category (nine in total) and elect their jury’s favorite.
• The vote by the public will take place from September 15th to October 26th, 2022 (The “Public Vote”), where the winner in each category will be designated. 
• Contest’s Prize will be on November 8th, 2022, at the Nespresso International headquarters, Chaussée de la Guinguette 10, 1800 Vevey, Switzerland.


4. Assessment criteria

Three main criteria will be looked at by the jury to elect the winners:
1. The company/initiative belongs to one of the six circular business models.
2. The company/initiative is highly innovative when approaching the circularity thinking.
3. The company/initiative has potential to succeed and scale up to a have a major impact.

Non-exhaustive examples of criteria that will be assessed:
• Innovation: How innovative is the proposed business model?
• Realization: Is the initiative already active in the market?
• Expansion: Does the business model have a potential for growth?
• Impact: Can the business model be replicated?
• Circularity: Can the business model be considered as an enhancer of circularity?


5. Organization

Nespresso and B-Lab are responsible for the organization and conduct of this Contest.


6. Eligibility & Participation

Subject to the following, the Contest is exclusively open to Participants based in Switzerland


7. Procedure of selection of the winners

Participants are invited to:
1. Connect on the Nespresso StartCup website (
2. Follow the guidance and send their three mandatory contributions (Business Model details, Business Summary, 60-90 seconds video).
3. Regarding video, entry is limited to original videos that have not formerly been displayed or exhibited previously on any platform or format and for which the Participant holds all applicable rights. Separate basic instructions regarding format will be provided. Non-compliant video will invalidate the entire entry.
4. A Participant may enter only once. Nespresso reserves the right at its sole discretion to disqualify any Participant found to be attempting to circumvent this clause by tampering with the operation of the Contest, setting up multiple accounts, using multiple identities or to be acting in any manner deemed by Nespresso to be in violation of the terms and conditions; or to be acting in any manner deemed by Nespresso to be disruptive.
5. Nespresso, at time to be confirmed, will do a preliminary assessment to validate the submissions from a compliance aspect (content in line with applicable laws, the challenge purpose and Nespresso / B-Lab values) and from a sustainability/circularity aspect.
6. The jury will select the finalists.
7. The selection of finalists will be contacted by August 26th, 2022 for media interviews. 1 winner per category will be selected by a public vote. Winners will be announced on November 8th, 2022.
8. Nespresso is entitled to cancel the Contest in a category in case the total number of submissions for such a category is fewer than 10 and reserves the right to alter or cancel the Contest in the event of unforeseen circumstances or to amend or update these Rules if circumstances require. No compensation will be due to any Participant in case of cancellation or alteration of the Contest or the event itself.
9. Nespresso is entitled to change the public vote award by jury selection in case of fraudulent activity and/or technical issues on such a public vote.


8.  Prizes

8.1 Prizes for participant

The first 100 Participants to submit a valid application will receive:
• 1 Vertuo Next machine (value Fr 149.-)
• 1 year of coffee equivalent to 40 CHF per month of coffee. Will be offered as a Nespresso credit in one time (value Fr 480.-)
• 1 Nespresso upcycling bin (value of Fr 25.-)

8.4 Prizes for Jury’s favorite

Any local taxes payable on the prize will be the sole responsibility of the prize winner. Cash prize payment will be executed 60 days after the winner’s announcement at the latest . No other alternative prize is available, except that in the event of circumstances outside of its control Nespresso reserves the right to substitute a similar alternative of equal or greater value.   Nespresso shall not be liable for any loss or damage whatsoever that is suffered by any Participant or winner (including but not limited to indirect or consequential loss), or for any personal injury suffered or sustained as a result of taking any prize, except for any liability that cannot be excluded by law.   The non-cash prize is non-transferable, non-refundable, non-exchangeable, non-replaceable and non-redeemable for cash.   No warranty or guarantee is given by Nespresso in relation to the elements of the prize outside its control.

Winners’ details will be managed by Nespresso and/or its agency for the sole purposes of administering the Contest and sending prizes and will be subject to Nespresso’s Privacy Policy which can be viewed at


10. Authorization & Release

By submitting an entry or participating in the Contest, the Participant authorizes Nestlé Nespresso S.A, Switzerland, its subsidiaries, affiliates, divisions, successors and assigns and those acting under its permission ("Nespresso") free of charge, worldwide to temporarily or permanently, directly or through third party licensees, without any limitation as to the number of passages and territories, use and exploit each selected submission as follows:
• reproduce, represent, adapt, perform and display the photo(s) and video(s) and (if any) his/her image and likeness appearing in the photo(s) and video(s) supplied to Nespresso, in whole or in part, in composite or distorted character or form or as otherwise changed, or reproductions thereof, in color or otherwise, with a real or fictitious name, now or at any time in the future.
• use, reproduce, distribute, make available, publish or broadcast by any process, means or media, including the Internet, the photo(s) and video(s) and (if any) his/her image and likeness appearing in the photo(s) and video(s) supplied to Nespresso in any way and manner Nespresso deems fit within the scope of its internal and external communication, notably for advertising, editorial, promotional, marketing and public relation purposes.
• insert a distinctive mark (figure, name, or other) of Nespresso.
The Participant grants to Nespresso all rights of every nature relating to the reproduction and use of such photo(s) and video(s) and waives any rights that he/she may have pursuant to any statute or law.

By submitting an entry or participating in the Contest, the Participant declares that he/she owns the copyright and has obtained the relevant authorization from third party (including personality rights) in the material supplied to Nespresso and declares to be lawfully entitled to agree to the authorization herein and warrants that he/she has not granted any right to any third party that could impair or restrict his/her ability to carry out the rights granted hereunder.

By submitting an entry or participating in the Contest, the Participant represents and warrants:
• That the content of its submission and the content uploaded do not contain any material which is in breach of the rights, pleas and claims of third parties, whether financial or personal.
• That he/she is fully aware that the participation in the Contest does not give rise to any inherent right or to any form of consideration.

By submitting an entry or participating in the Contest, the Participant acknowledge that any submitted information is being provided on a non-confidential basis and that Nespresso maybe working on competing projects.
The Participants acknowledge and understand that by submitting an entry on a non-confidential base it may inadvertently, impact their ability to protect their eventual Intellectual Property rights.
If Nespresso has a further interested in the Participant’s idea and requires more information, an additional agreement can be entered into.

By entering the Contest, the winner acknowledges that he/she may be required to participate in publicity relating to the Contest without further consent or payment. Such publicity may include, without limitation, the Participant’s name and/or their image or likeness, and statements made by the Participant concerning the Contest.


11. Intellectual property

All trademarks, brands, logos and other materials or content in relation to the Contest are the exclusive property of Nespresso and may not be downloaded, copied, saved, modified or otherwise distributed or used for any purposes other than as envisaged by the Rules for participating in the Contest.


12. General

Nespresso’s decisions regarding the Contest will be final and binding. In the event of circumstances outside its reasonable control and only where circumstances make this unavoidable, Nespresso reserves the right to cancel or amend the Contest or these terms and conditions at any stage but will always endeavor to minimize the effect to Participants in order to avoid undue disappointment. No compensation will be due to the Participant in case of cancellation or alteration of the Contest or the event itself. Nespresso will publish any amended or updated Rules, which shall then apply to all existing and future entries. If a Participant does not agree to any such changes, the sole remedy shall be to withdraw their entry from the Contest.

12.1   These Rules are published in English, French, German and Italian. In the event of contradictions or difference of interpretation between the French, German, Italian and English versions, the English version shall prevail.

12.2   If a Participant cheats, or if a virus, bug, catastrophic event, or any other unforeseen or unexpected event that cannot be reasonably anticipated or controlled (also referred to as force majeure) affects the fairness and/or integrity of this Contest, Nespresso reserves the right to cancel, change or suspend this Contest. This right is reserved whether the event is due to human or technical error. If a solution cannot be found to restore the integrity of the Contest, we reserve the right to select winners from among all eligible entries received before we had to cancel, change or suspend the Contest. Nespresso reserves the right to proceed, as deemed opportune and in line with current laws in force, to limit and curtail any action aimed at circumventing the applicable system. Any fraud or attempted fraud shall be duly reported in terms of law.

12.3 Nespresso does not assume any responsibility with respect to any technical malfunction of the hardware or software, interruption to the Internet connection, failed, incorrect, inaccurate, incomplete, illegible, damaged, lost, delayed, incorrectly addressed or intercepted registration by the Participant, or any other registration by the Participant which for any reason was not received by Nespresso, electronic communications of any other kind which were delayed or any other technical problem linked to the registration by the Participant and to the upload of the videos in the course of this initiative. Likewise, Nespresso does not give the Participant any guarantee of proper functioning of the Website and of the programs forming part thereof.

12.4   These Rules are governed by Swiss law and any disputes which cannot first be settled amicably shall be submitted exclusively to the courts of Canton Vaud, Switzerland.

12.5   Nespresso will publish any amended or updated Rules, which shall then apply to all existing and future entries. If a Participant does not agree to any such changes, the sole remedy shall be to withdraw their entry from the Contest.

To ensure fairness and the integrity of the Contest to all Participants, Nespresso will not enter discussions regarding the running of this Contest via social media but will respond to the Participant.
